New York State Contractor and Subcontractor Registration Requirement

Effective December 30, 2024, a new registration requirement under Labor Law Section 220-i impacts contractors and subcontractors working on certain public and private projects in New York State. Below is an overview of the law and what you need to do to stay compliant.

Who Does This Affect?

This law applies to:

  • Contractors: Entities entering contracts to perform construction, demolition, renovation, or related work.
  • Subcontractors: Entities hired by contractors to perform these types of work.

Both contractors and subcontractors must register with the New York State Department of Labor (NYSDOL).

What Project Are Covered?

The registration requirement applies to:

  1. Public Work Projects
  2. Private Projects covered by Article 8 of the Labor Law, including:
    • Public subsidy-funded projects (Section 224-a)
    • Renewable energy systems (Section 224-d)
    • Broadband projects (Section 224-e)
    • Climate risk and energy transition projects and roadway excavations (Section 224-f)

What Are Your Responsibilities?

  • Contractors must register before submitting bids or starting new work on covered projects.
  • Subcontractors must register before starting new work on covered projects.
  • Contractors are responsible for verifying that their subcontractors are registered.

Why Register Early?

To avoid delays, the NYSDOL recommends completing registration as soon as possible. Early registration ensures you receive a Certificate of Registration, which is required to bid on or start work for covered projects.
